Acceptance of Terms

By using the Site or the Service in any way, you agree to abide by these Terms. Additionally, when using specific services provided by Smailads.com, you agree to follow any applicable published guidelines for those services, which may change from time to time. Please report any violations of these Terms to Service@Smailads.com. If you object to any part of these Terms, any guidelines, any subsequent modifications, or if you are dissatisfied with Smailads.com in any way, your only remedy is to immediately discontinue using the Site, the Application, and the Service. Smailads.com is not liable for any loss or damage resulting from non-compliance with these Terms of Service. Smailads.com may update these Terms, and you understand and agree that it is solely your responsibility to review these Terms periodically. You can always review the latest version of these Terms on the "Terms of Use" page at the bottom of the page under the "Information" section. Any continued use of the Site, Application, or Service after posting these modified Terms or sending information related to this modification constitutes your agreement and acceptance of these modified Terms. You understand and agree that unless explicitly stated, Smailads.com does not control, verify, or endorse any information contained in or available through the Service, including listings, links, messages, advertisements, or reviews.
Registration
Although registration is not required to use the Service or access the Site and Application, if you choose to register, you must complete the Smailads.com registration process. If you choose to register, you must provide a valid email address, select a username, and create a password during registration. You must be at least 18 years old. You are responsible for maintaining the confidentiality of your username and password and all uses of your account, whether or not you authorized such use. You agree to notify Smailads.com immediately of any unauthorized use of your account. Smailads.com reserves the right to refuse service or access to the Site and Application to any user or to delete accounts created by users who use another person’s name, likeness, email address, or other personal identification information.
Content
You understand that all listings, messages, texts, files, images, videos, audio, or other materials ("Content") posted on the Site and Application or transmitted through it or linked to it are the responsibility of the person or entity from whom such Content originated. You also understand that Smailads.com does not control and is not responsible for Content available through the Site and Application and that, by using the Site and Application, you may be exposed to Content that is offensive, inappropriate, inaccurate, misleading, or otherwise undesirable. Furthermore, the Site, Application, and Content available through them may contain links to other websites that are completely independent of Smailads.com. Smailads.com makes no representations or warranties regarding the accuracy, completeness, or validity of the information contained on this website. Under no circumstances will Smailads.com be responsible for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, linked, or otherwise made available via the Site and Application. You understand and agree that any uploading or posting is done at your own discretion and risk and that Smailads.com will not be liable to you in any way. Moreover, Smailads.com makes no guarantees regarding your use of any third-party Content or software obtained from the Site and Application. You are solely responsible for any Content you post on the Site and Application and the consequences of any such Content. You also understand and agree that Web Annonces Technologie "Smailads.com" may, in its sole discretion, delete any Content for any reason from Smailads.com.
User Conduct
You agree to act responsibly and treat other users with respect. Users must not use the Site, Application, or Service to harass or abuse other users. Individuals who have harassed other individuals may be removed from the Service or banned from the Site and Application. You agree not to post, email, or make available Content that:
- Is unlawful, harassing, defamatory, abusive, threatening, harmful, bigoted, racially offensive, obscene, or otherwise objectionable.
- Advertises any illegal services or the sale of items prohibited or restricted by applicable law.
- Harms minors or contains sexually explicit material of any kind.
- Encourages conduct that would constitute a criminal offense, give rise to civil liability, or violate any applicable law, regulation, or international law.
- Transmits or posts unauthorized advertising, spam, junk mail, chain letters, or pyramid schemes.
- Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights.
- Transmits or posts any viruses or materials designed to disrupt, limit, or destroy any functionality of any computer software or hardware belonging to users, members, or Smailads.com.
- Collects or solicits information about other users or members for commercial or unlawful purposes or engages in commercial activity such as contests or sweepstakes without prior consent from Smailads.com.
- Contains another member's personally identifiable information without their explicit consent.
- Contains misleading email addresses or manipulated identifiers to disguise the origin.
- Is deliberately posted in an irrelevant category or city, or repeatedly posts the same or similar content, imposing an unreasonable or disproportionately large load on Smailads.com’s infrastructure.
- Is from more than one member account.
- Circumvents or attempts to circumvent any security measures related to using the Site, Application, or Services.
No Spam Policy
You understand and agree that sending unsolicited email advertisements to Smailads.com email addresses or through Smailads.com’s computer systems, which this policy expressly prohibits, will use or cause servers located in California to be used. Any unauthorized use of Smailads.com’s computer systems is a violation of these Terms and certain federal and state laws, including, but not limited to, the Computer Fraud and Abuse Act (18 U.S.C. § 1030 et seq.), Section 502 of the California Penal Code, and Section 17538.45 of the California Business and Professions Code. Such violations may subject the sender and their agents to civil and criminal penalties.
